1.2. ServerHub.dev is a platform that provides tools and software to help you easily manage and monitor your servers (hereafter referred to as the “Software”). You can access the Software via the https://serverhub.dev website (hereafter referred to as the “Website”), the ServerHub.dev mobile application (the “Mobile App”), or software installed on your server (the “Server Monitoring Software”).
1.3. These Terms of Use govern your use of the Software and form a legally binding agreement between you and 7Stockapp OÜ. Please read these Terms carefully before using the platform. If you do not agree to these Terms, you must stop using the platform.
1.4. You are granted a limited, non-exclusive, non-transferable, revocable license to use the ServerHub.dev Mobile App on Apple-branded products that you own or control and as permitted by the App Store Terms of Service.
2. Acceptance of Terms
2.1. By using the platform, you agree to these Terms of Use and all policies referenced herein.
2.2. We reserve the right to amend these Terms of Use at any time. Changes will take effect from the date they are published on the Website or Mobile App. Continued use of the platform after such changes signifies your acceptance of the amended Terms.
3. User Responsibilities
3.1. You may only use the platform for lawful purposes and as outlined in these Terms.
3.2. Regarding the use of Server Monitoring Software:
– You are responsible for regularly monitoring the impact of the software on your server’s performance.
– Proper installation and configuration of the software are solely your responsibility.
– ServerHub.dev will not be held liable for any issues arising from the use of the software (e.g., data loss, performance degradation, security vulnerabilities, or server malfunctions).
3.3. You agree not to copy, modify, reverse-engineer, decompile, disassemble, attempt to derive the source code of, or create derivative works of the app, except as permitted by law or as expressly authorized by 7Stockapp OÜ.
3.4. Your use of the app may require compliance with third-party terms of agreement, including but not limited to Apple’s App Store Terms of Service.
4. Disclaimer of Liability
4.1. Your use of the platform, including the Mobile App, Website, and Server Monitoring Software, is at your own risk. We make no guarantees about the performance or error-free operation of the Software.
4.2. ServerHub.dev shall not be held liable for any damages or losses, including but not limited to:
– Issues resulting from the installation or misconfiguration of the Server Monitoring Software.
– Data loss, security breaches, or unauthorized access occurring during the use of the software.
– Server performance degradation or system malfunctions caused by changes made using the software.
– Service interruptions or downtime on the Mobile App or Website.
4.3. Apple is not responsible for the app or its content. To the maximum extent permitted by applicable law, Apple shall have no warranty obligation whatsoever with respect to the app and any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the app to conform to any warranty.
4.4. In no event shall ServerHub.dev be liable for direct, indirect, special, or consequential damages of any kind.
4.5. You are responsible for regularly monitoring the effects of the Server Monitoring Software and taking appropriate measures to address any issues.
5. Fees and Payment
5.1. The platform offers various subscription plans. Detailed information about these plans is available on the Website or Mobile App.
5.2. All payments are processed securely, and you are responsible for ensuring that your payment information is accurate and up to date.
5.3. All fees are non-refundable unless otherwise required by applicable law.
6. Data Collection and Privacy
6.1. Data Collection: Certain data may be collected during your use of the platform, such as account details, server performance, connection status, resource usage, and payment information. This data will be used only in accordance with our Privacy Policy.
6.2. Server Monitoring Software: The Server Monitoring Software collects information such as server performance, uptime, resource usage, and other metrics related to your server. This information is transmitted to our platform for monitoring purposes. You are responsible for ensuring the software is installed and configured correctly on your
servers.
6.3. Data Deletion: If you wish to delete your account and associated data, you may request this at any time by contacting us at [email protected]. Upon receiving your request, we will delete your personal information, including your account details, payment information, and server performance data, in accordance with our data retention policy. 10. Maintenance and Support
10.1. 7Stockapp OÜ is solely responsible for providing maintenance and support for this application. Apple has no obligation whatsoever to furnish any maintenance and support services for the app.
